The National Association of Professional Employer Organizations (NAPEO) is the largest trade association for professional employer organizations (PEOs) nationwide. NAPEO provides robust member resources, vital networking and referrals, hard-hitting education, and effective public relations and marketing support. NAPEO advocates for the interests of its PEO members at all levels of government.
Professional Employer Organizations (PEOs) provide human resource services to their small business clientspaying wages and taxes and assuming responsibility and liability for compliance with myriad state and federal laws and regulations. In addition, PEOs often provide workers with access to 401(k) plans, health, dental and life insurance, dependent care and other benefits not typically provided by small businesses. Between 2 and 3 million people are covered by a PEO arrangement.

The House Committee on Commerce, Labor, and Technology adopted a tax clarification to Senate Bill 139 that modernizes Ohios PEO law. Under the bill as proposed, clients would not be disadvantaged for using PEO services. At the request of the governor, the bill was further clarified that only the client, not the PEO, may count worksite employees for the purposes of economic incentives. The bill modernizes Ohios PEO law, establishing legal certainty, outlining client and PEO responsibilities, and enhancing minimal financial and operational requirements. The bill is expected to be heard again before the committee and reported out next week before being considered by the full house.

Both chambers of the Kansas Legislature have adopted a PEO conference report clearing the way for the enactment of comprehensive PEO legislation in the state. The NAPEO-backed measure would provide PEOs operating in the state with legal clarity and operational certainty. House Bill 2077 is substantially similar to the NAPEO model act and provides clarity of PEOs and clients rights, duties, and obligations. The bill will be enrolled and sent to the governor for signature.

The Michigan Bureau of Commercial Services (BCS) of the Licensing and Regulatory Agency (LARA) has published forms necessary for PEOs to obtain licenses from the state. Both the PEO Licensing Application and the PEO Limited License Application have been posted on the BCS website. PEOs operating in the state must submit applications for licensure no later than July 1, 2012. Once applications are received, the BCS will issue licenses by September 1, 2012. After that date, no PEO may operate in the state without first obtaining a license. The new PEO statutory provisions include significant portions of the NAPEO model act and provide a solid statutory framework for reasonable regulatory standards. The new law clarifies the PEO relationship and protects PEOs from undue liabilities.
